Website Terms, Conditions & Rebate Eligibility

Welcome to Mortgage Cashback. We are pleased to help you secure a great home loan and share our ongoing trailing commissions with you.

These Terms and Conditions ("Terms") govern your use of our website and the rules for participating in our trailing commission rebate program. By accessing our website or engaging our services, you agree to these Terms. Please read them carefully.   

1.0 Statutory Licensing & Regulatory Disclosure

This website provides general information only and has been prepared without taking into account your objectives, financial situation or needs. Your full financial situation and requirements need to be considered prior to any offer and acceptance of a loan product.

2.0 Best Interests & Rebate Disclosure

Our recommendation prioritises your specific objectives and financial requirements. This credit assistance is provided in your best interests based on your requirements and objectives. Separately, 100% of trailing commissions (exclusive of GST) received by us are rebated to you annually in December under our terms and conditions. This rebate is a secondary benefit and does not influence our lender selection.

Lender selection is made solely on the basis of your best interests. The trailing commission rebate is a voluntary, secondary benefit provided by Mortgage Cashback from its own received revenue. It does not form part of our credit assistance obligations, nor does it influence the lender or product we recommend to you.   

3.0 How Our Rebate Program Works

Mortgage Cashback voluntarily shares the trailing commissions it receives from lenders directly with eligible clients. Because this rebate is funded entirely from revenue generated by your loan, participation is subject to the eligibility conditions set out below.

The rebate is not a fee, not a product feature, and not a contractual obligation of credit. It is a voluntary sharing of Mortgage Cashback’s own commission income with qualifying clients.   

3.1 Eligibility Conditions

To qualify for and continue receiving your annual rebate, your home loan must meet the following baseline conditions:

  • Initial Qualifying Balance: Your individual loan account(s) must result in an upfront commission amount payable on a minimum initial settlement balance of $350,000 in interest-bearing funds (net of offset).
  • Ongoing Rebate Calculation: After the first month of settlement, there is no requirement to maintain the $350,000 minimum balance to remain in the rebate scheme. However, rebate calculations are based solely on the actual interest-bearing portion of your loan balance as reported by the lender to us each month, excluding GST.
  • Offset & Redraw Impact: Funds held in an offset account or redraw facility reduce your interest-bearing balance. This will proportionally reduce the trailing commission paid by the lender to us, and therefore reduce your rebate amount for that period. 
  • Taxation: We are not authorised to provided personal financial advice or formal guidance related to any tax matters. Please seek independent financial and/or financial advice relating to any rebates.

3.2 Lender Clawbacks & Rebate Adjustments

When a loan is refinanced, discharged, or significantly reduced within a lender’s commission recovery window (typically 18 to 24 months from settlement), the lender may recover (claw back) the upfront commission it previously paid to us. To account for lender processing timelines and arrears-based reporting, Mortgage Cashback applies a 25-month review period from your settlement date.

If a lender enforces an upfront commission clawback against Mortgage Cashback during this 25-month period, the following adjustment applies:

  • Any trailing commissions collected by Mortgage Cashback on your behalf that have not yet been distributed in the annual December rebate cycle will be retained by Mortgage Cashback.
  • This retention applies only up to the dollar amount of the upfront commission recovered by the lender — not in excess of it.
  • No further funds will be sought from you. You will not be required to repay any previously received rebate payments.   Not a Fee or Deferred Charge: For the avoidance of doubt, this adjustment is not, and must not be construed as, a fee, penalty, deferred fee, charge, or any financial obligation imposed on you. Mortgage Cashback will never ask you to pay any money out of pocket in connection with a clawback event. This provision operates solely to reduce or forfeit Mortgage Cashback’s voluntary rebate where the commission revenue funding that rebate has been recovered by the originating lender. Your only exposure is the non-receipt of a rebate payment — never a liability to pay.   

3.3 Rebate Calculation & Payment

  • Your rebate is calculated based on the net trailing commissions Mortgage Cashback receives from your lender, exclusive of GST.
  • Rebates are processed annually each December, paid directly to your nominated Australian bank account.
  • Your loan must remain active and continue to meet the eligibility conditions in Section 3.1 at the time of payment processing.   

4.0 Credit Assistance & Best Interests Obligations

Mortgage Cashback holds Credit Representative status under Australian Credit Licence 389328 and is bound by the obligations of the National Consumer Credit Protection Act 2009 (Cth), including the best interests duty applicable to mortgage brokers.

Our obligations to you include:

  • Acting in your best interests when recommending a home loan product.
  • Prioritising your financial objectives, situation and requirements when selecting a lender.
  • Disclosing all remuneration, including commissions and rebates, as required by law.
  • Ensuring that our rebate program does not conflict with, or influence, our credit assistance recommendations.   Full details of our obligations, remuneration, and how we manage conflicts of interest are set out in our Credit Guide, which is available on this website.   

5.0 General Website Use

5.1 No Financial or Credit Advice

The content on this website is for general educational and promotional purposes only. Tools, calculators, and illustrative figures on this website do not constitute a credit application, credit assessment, formal offer of credit, legal advice, financial advice, or tax advice. All loan applications are subject to formal lender credit assessment and approval.

5.2 Website Accuracy

Mortgage Cashback makes reasonable efforts to keep the information on this website accurate and current. However, lender policies, interest rates, commission structures, and regulatory requirements change frequently. We do not warrant the accuracy, completeness, or fitness for purpose of any third-party lender information, rates, or tools displayed on this website.

5.3 Privacy

Any personal information collected through this website is handled in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy, available on this website, sets out how we collect, use, store, and disclose your personal information.

5.4 Limitation of Liability

To the maximum extent permitted by applicable law, Mortgage Cashback, its directors, officers, employees, agents and representatives will not be liable for any direct, indirect, incidental, consequential or special loss or damage arising from your use of this website or reliance on any information contained on it. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

5.5 Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Victoria and applicable Commonwealth of Australia legislation. By using our services, you agree to submit to the non-exclusive jurisdiction of the courts of Victoria for any disputes arising in connection with these Terms. Mortgage Cashback provides services nationally across Australia.

5.6 Amendments to These Terms

Mortgage Cashback reserves the right to update or amend these Terms at any time. The version displayed on this website is always the current version. Continued use of our services following any update constitutes your acceptance of the revised Terms.
